Course Overview
This course was developed specifically for litigation support professionals with advanced electronic discovery experience and is based on feedback received from the general Electronic Discovery Certification Course attendees. The course is designed as a logical next step for past attendees of that course, but also is open to others who have demonstrated considerable expertise in electronic discovery processes and procedures. Some of the topics to be covered include: tactics to leverage keyword and concept searching capabilities; search and production strategies for metadata; and electronic discovery project management techniques.

Demystifying Metadata
Metadata can be a valuable litigation and internal investigation tool, yet like other forms of electronically-stored information it implicates a variety of new concerns. This session will expose common metadata myths and reveal various approaches for properly handling metadata. Topics to be discussed include:

  • Emerging legal standards relating to metadata
  • Using metadata in legal discovery & internal investigations
  • Metadata filtering and searching tips
  • Including metadata in a document review
  • Avoiding metadata production issues
  • Metadata scrubbing and other spoliation considerations

Managing an E-discovery Project
You have been asked to prepare the electronic document collection so that legal review may commence. What are the key steps; what information will you need to know; and how can you manage against the deadline? During this session you can expect to learn:

  • How to assess the skills and ability of your internal team
  • How to select and work with external experts
  • Strategies for coordinating large-scale document reviews
  • Techniques for crisis management and handling the aftermath

Federal Rules Changes: An Overview of the Practical Impacts for Legal Teams
New Amendments to the Federal Rules of Civil Procedure addressing the discovery of electronically stored information became law in December, 2006. The new Rules provide legal teams with additional guidance for dealing with issues surrounding electronic discovery including production, scope and cost considerations. Join us to learn more about these provisions and their expected implications for legal teams.

Electronic search tools can be employed at various phases of the e-discovery process to sort, sift and prioritize data sets. This presentation will discuss various search considerations and techniques that may be employed for:

  • Reducing the data set through pre-review filtering and processing
  • Selecting an appropriate online review tool, focusing on searching capabilities
  • How and when to consider using conceptual search and review technologies
  • Post-processing searching and sorting during review

Lunch: Share Your E-Discovery Project Management Strategies
Pick up your lunch and join a small group to discuss some of your past electronic discovery project management challenges and the tips and tricks you have learned along the way.

Native File Productions
Are you under a court order to produce native files? Do the potential cost savings of a native file production interest you? What are the looming native file production pitfalls? In this session we will cover the pros and cons of requesting and producing files in native format. Topics to be discussed will include:

  • Benefits, drawbacks and cost considerations
  • File numbering methods & post-production management of the document set
  • When to seek native production from an opponent
  • Tips for educating lawyers and judges on the best course of action when it comes to native file production

Coordinating the details behind a large-scale document review takes additional planning and organization. In this session you will gain the knowledge to handle the technical and not-so-technical details of your next online review. Topics to be covered include:

  • Developing a review plan: people, facilities, technology and costs
  • Estimating the time needed to complete the review
  • Addressing technical and security issues when setting up online review workstations
  • Evaluating network connectivity needs
  • Assembling and training a review team

Long-term E-Discovery Project Management
What happens after the electronic documents are collected, filtered, reviewed, and produced? Explore the events that occur after you complete your e-discovery work, as the case continues and possibly proceeds to court. Topics to be covered in this session include:

  • Long-term e-discovery case management activity - what’s your role?
  • How do you archive the production set of electronic documents?
  • The importance of team-wide communication post-production
  • The possibility of recycling previous data sets for future related litigation

Real World Challenges
Break into small groups to consider potential solutions to some e-discovery challenges. Attendees will be invited to pre-submit scenarios reflecting their real-life challenges for this discussion. Nominate a group spokesperson and rejoin the large group at 1:15 pm to discuss your answers.
