Course Overview

Kroll Ontrack offers dynamic educational programs to keep corporations, law firms and government entities on the leading edge of the evolution of law and technology. Kroll Ontrack's E-Discovery Certification Course is the most highly-acclaimed program for legal and technical professionals seeking to expand their information management, e-discovery and computer forensics knowledge. In response to new legal and technical developments and feedback from our attendees, Kroll Ontrack has redesigned its 2010 course curriculum. This new course offers several breakout sessions designed to appeal to beginner, intermediate and advanced learners, with both legal and IT backgrounds.

This course was developed for legal and technical professionals of all levels including in-house counsel, IT staff, law firm attorneys, litigation support professionals, paralegals, and government officials. Any individual with responsibility to identify, preserve, collect, review and produce ESI in an investigation, litigation or regulatory matter should attend this course.

Course Format

The two-day course is held at Kroll Ontrack's corporate headquarters near Minneapolis, Minnesota and is comprised of large and small group break-out sessions. Attendees will choose curriculum with either a legal or IT focus. Attendance is limited to approximately 50 participants for each course, to allow for open discussion.

Travel & Accommodations

Participants are responsible for arranging and paying for airfare and hotel accommodations. Please reference the Kroll Ontrack room block when making your reservations. Kroll Ontrack will provide you with hotel booking information upon confirmation of your registration. Please do not make arrangements for travel and lodging until you receive registration confirmation.

Tuition: $1500 ($995 early bird rate available for each course if you register at least 2 weeks prior to event)

  • This fee is non-refundable but may be credited for future events.
  • Tuition includes all course materials, lunch and refreshments while at the training facility, and transportation between the Westin Edina Galleria and course location.

Registration Information

This course is limited to individuals providing traditional legal, IT and litigation support roles on behalf of law firms and corporations. Service providers and consultants are excluded from this course. There is no room for creativity in recordkeeping. Building, implementing and maintaining best of breed recordkeeping protocol requires adherence to process. It also requires that records managers understand where and how data is created and stored, and incorporate emerging technologies and storage mediums into existing protocol. This session will explore new standards of recordkeeping and balance legal concerns with IT and business requirements.

Option A: E-Discovery Challenges: Global Disputes & Investigations

The integration of the global business community has led to an increase in cross-border litigation, making challenging electronic discovery projects even more difficult. This session will provide a perspective from the UK on issues involved in global litigation and regulatory investigations, and will present solutions that can help ensure an organization’s success in these financially trying times. Among the topics to be covered are:

  • The prevalence of global litigation
  • Challenges in international discovery
  • The impact of the economy on organizations in relation to discovery/disclosure
  • Solutions for reducing litigation risk and containing legal costs

Option B: All You Need to Know about Privilege
With the rapid proliferation of electronically stored information, preventing the inadvertent production of privileged information has never been more difficult. Responding to this, Congress enacted Federal Rule of Evidence 502 with the intent to provide protection against waiver of privilege and to decrease the financial burden of litigation. This begs the question – how has Rule 502 played out in practice? What other practices will preserve privilege? This session will:

  • Provide an overview of Rule 502
  • Explore additional privilege safeguards
  • Discuss lessons learned from recent court decisions regarding privilege

Knowing when the duty to preserve arises remains one of the most challenging aspects of the electronic discovery process. Effective response requires scoping for key players and sources of data to be preserved, as well as implementing and monitoring legal hold notices. This session will discuss defensible techniques to identify, collect and preserve data to start your response off on the right foot.

Advanced searching techniques, such as concept searching, near de-duplication and e-mail threading, are gaining traction. But, what do these terms mean exactly? How are they used to conduct a cost-effective, defensible search? And, what about getting the most out of keyword searches? This presentation will explore well-established and emerging search technologies, and provide best practices to increase the effectiveness of your next search process.

This presentation will discuss the pyramid of success necessary for any document review project.

Option B: The Technological Advantage: Effective Review Tool Use
The success of a case rests on the quality of evidence presented. A good review tool will allow your review team to find and highlight those documents that are crucial to your case. This presentation will offer tried and true tips and techniques in getting the most out of your review tool.
