Computer Forensics Case Study: Sales Data Subpoenaed

A large Fortune 500 company approached Kroll Ontrack for help with responding to a subpoena to produce sales-related information on one of the company's chemical products. This task was extremely complex as they had to collect and produce information from 100 key custodians across the country, 75 of which worked from home. Within 24 hours, Kroll Ontrack had a team of seven experts at their headquarters prepared to take action.

Computer forensics and investigations repair and mitigate damage caused by fraud or wrong-doing and help prevent future incidents.

Best Practices Applied

Kroll Ontrack's team of experts, consisting of ESI consultants, computer forensics experts, and e-discovery teams, assisted the client in several ways. First, Kroll Ontrack's ESI consulting team developed and implemented document preservation notice plans and ESI tracking methods. They suspended systematic and employee-initiated purge processes, a vital step to adhere to the duty to preserve and prevent the inadvertent spoliation of relevant information. Finally, the ESI consultants interviewed the custodians regarding their computer usage and storage. This entire process was thoroughly documented for future use in the client's litigation.

Next, Kroll Ontrack's ESI and computer forensics consulting teams created and implemented sound and responsible data collection strategies to address the large number of discovery requests. These collection efforts were coordinated and documented by the Kroll Ontrack experts. The ESI consulting group also helped the client prepare for Fed.R.Civ.P. 30(b)(6) depositions and served as the expert witness at trial. The on-site engineers forensically captured the ESI while adhering to stringent chain of custody protocols.

Mission Accomplished

After collecting and assembling the documents, Kroll Ontrack's electronic discovery group processed, reviewed and produced the collected data within the designated timeframe. Ultimately, the Kroll Ontrack team successfully assisted the client by effectively managing the demands of the case while adhering to time and budget constraints.
