Jeffrey J. Joyce, Esq., Vice President

Jeffrey J. Joyce is the Vice President of Ontrack Consulting, Kroll Ontrack’s electronically stored information (ESI) consulting group. He directs and oversees teams of consultants who advise both corporate and law firm clients on issues involving ESI, including litigation readiness, litigation response, and ESI compliance. He manages the consultants in assisting clients with data and application inventories, data accessibility assessments, preservation notice management, custodian interviews and tracking, E-discovery plan record keeping, and ESI best practices to achieve repeatable, efficient, and reliable procedures. He also assists clients in identifying, preserving, collecting, and producing ESI in response to litigation and investigations. Prior to his current role, Mr. Joyce was first an associate and then a partner at Jones Day, one of the ten largest law firms worldwide. In his seventeen years with Jones Day, he litigated a variety of complex matters, including class actions, product liability, securities, employment, and contract disputes. He was also a member of the firm’s electronic discovery committee and an author and speaker on the subject of electronic evidence discovery. Mr. Joyce holds Juris Doctor and Bachelor of Science in Mechanical Engineering degrees from Ohio State University.

David E. Canfield, Managing Consultant

David E. Canfield is a managing consultant in Kroll Ontrack’s electronically stored information consulting group. He assists clients in the creation of discovery, data collection and case management strategies and with the creation of systematic processes and documentation to support repeatable, efficient and reliable electronic discovery procedures. He also helps clients with litigation readiness and litigation cost mitigation related to electronic data. Previously, Mr. Canfield was a senior advisor in electronic legal discovery for a global pharmaceutical company where he was responsible for the collection, preservation and production of electronic data for the legal discovery process for all global operations. Prior, he spent nearly 20 years in IT management and senior management positions, responsible for electronic data discovery preservation, production procedures and disaster recovery procedures as well as developing computer forensics response protocols and procedures to assist investigations involving law enforcement agencies. Mr. Canfield holds a Masters Certificate in Project Management from Villanova University and a Bachelor of Science degree in biology from Alderson-Broaddus College. He is working toward an Executive Juris Doctorate, expected in 2008.

John Connell, Managing Consultant

As a managing consultant in Kroll Ontrack’s electronically stored information consulting group, John Connell assesses clients’ electronic discovery resources, including documented processes, data repositories and system tools and helps them create discovery, data collection and case management strategies. He also assists clients with the creation of processes and documentation to support repeatable and reliable electronic discovery procedures and performs expert witness services related to cost/burden demonstrations concerning electronic data. Prior to Kroll Ontrack, Mr. Connell was electronic discovery manager for a major U.S. financial institution where he led a team responsible for responding to inquiries and investigations by various agencies including the SEC, NASD, IRS, FBI, Secret Service and the U.S. Attorney General. He made risk/reward decisions to prioritize responses to investigations and inquiries and functioned as an expert witness for depositions in high exposure cases. Previously, he held consulting positions at major IT consulting firms. Mr. Connell holds a Master of Business Administration degree from Wake Forest University and a Bachelor of Science degree in Systems Science Engineering from University of Pennsylvania—School of Engineering and Applied Science.

Richard P. Kessler, Managing Consultant

Richard P. Kessler is a managing consultant in Kroll Ontrack’s electronically stored information (ESI) consulting group. He assists clients with the creation of discovery, data collection and case management strategies and assesses client electronic discovery resources including documented processes, data repositories and system tools. Mr. Kessler works directly with clients to create systematic processes and documentation to support repeatable, efficient and reliable electronic discovery procedures – maximizing litigation readiness and mitigating litigation costs. Previously, Mr. Kessler was a Vice President for Citigroup Architecture and Technology Engineering, developing and championing a multitude of strategies and processes to analyze and improve electronic discovery and the corresponding technology infrastructure. Prior, he spent over 20 years in IT and senior management positions for banking and financial institutions developing strategies and complex solutions for all facets of knowledge management, customizing and implementing standard process documentation tools and managing disaster recovery planning and compliance. Mr. Kessler studied Electrical Engineering and Computer Science at Polytechnic University in Farmingdale, New York.

Daniel Weathersby, Managing Consultant

As a managing consultant in Kroll Ontrack’s electronically stored information (ESI) consulting group, Daniel Weathersby works with clients to design and implement discovery, data collection and case management strategies to maximize litigation readiness while mitigating costs. Specifically, Mr. Weathersby assists in creating systemic processes and documentation to support repeatable, efficient and reliable electronic discovery and records and information management programs, thereby ensuring compliance and bridging IT and legal discovery responses. Prior to joining Kroll Ontrack, Mr. Weathersby spent over 14 years managing and supporting IT initiatives in various capacities. As an IT records manager and administrator for HSBC North America (HSBCNA), Mr. Weathersby was responsible for the e-records management of all businesses and ensured compliance with legal and regulatory statues. He also managed and coordinated efforts for SOX testing and compliance for HSBCNA, providing accurate and concise reporting and updates for senior management. Prior to HSBCNA, he also gained expertise in implementing a data classifying program, assessing risk to technology and rating business and technology controls as a technology risk program manager. Mr. Weathersby holds a Masters of Science degree (M.S.) in Management of Technology (MOT) from the University of Minnesota. He received his Bachelor of Arts (B.A.) degree in non-profit management from Michigan State University.

Wayne Wong, Managing Consultant

Wayne Wong is a managing consultant in Kroll Ontrack’s electronically stored information (ESI) consulting group. In this role, Mr. Wong ensures litigation preparedness for clients through the creation of discovery, data collection and case management strategies to support repeatable, efficient and reliable electronic discovery procedures. Backed by 25 years of technology experience and the industry’s leading software tools, Mr. Wong works directly with clients to assess their electronic discovery capabilities and offers proactive solutions to manage ESI. Additionally, when litigation is imminent or already in progress, he advises clients on tactics for responding, including developing and implementing techniques and documentation for the accurate and complete identification, preservation, and collection of relevant ESI and ultimately providing guidance in all areas of records and information management to maximize efficiencies while mitigating costs. Prior to joining the Kroll Ontrack team, Mr. Wong was a senior information technology consultant and for a large electronic discovery vendor where he launched a strategic records and information management consulting practice to support litigation readiness and response. Specifically, Mr. Wong was responsible for identifying and rectifying technical areas where the client may not be fully prepared for handling e-discovery issues should litigation or other legal document requests arise. Mr. Wong has spent over 20 years gaining extensive information and legal technology expertise, most recently as Chief Technology Officer with Morse Best Innovation and Gear.com Inc., where he was responsible for technology architecture and technology/e-commerce strategy respectively. Mr. Wong holds a Master of Business Administration degree from the University of Puget Sound in Tacoma, Washington, and a Bachelor of Science degree from the University of Washington in Seattle.

  Karen D. Andersen, Consultant

As a consultant in Kroll Ontrack’s electronically stored information (ESI) consulting group, Karen Andersen advises corporations and law firms on all facets of ESI, from identifying, preserving, collecting and producing ESI to litigation readiness and response. Ms. Andersen facilitates the development of discovery, data collection and case management strategies and provides assessment of current electronic discovery resources – documented processes, data repositories and system tools. She works directly with clients to create systematic documentation to support repeatable, efficient and reliable electronic discovery best practices.
Prior to joining the ESI consulting group, Ms. Andersen was an Electronic Discovery Project Manager for the Legal Technologies Division of Kroll Ontrack. In that role, she consulted and advised clients on processing capabilities, keyword strategies, technical solutions and production formats. Additionally she worked face to face with clients – participating in preferred vendor selection, advising through all phases of discovery projects and ensuring complete client satisfaction. As a result, Ms. Andersen is recognized for her competency in handling challenging and/or unusual technical requirements as well as complex discovery requests and projects.
Ms. Andersen gained over eight years of technical experience before joining Kroll Ontrack, including six years at Thomson West. Her accomplishments include SAP implementations, database performance tuning, code enhancements and upgrades, data archiving, security design and implementation, production support, backups and restores. Ms. Andersen also holds experience with implementations of Westkm, a proprietary knowledge management application, including performing upgrades and system test. Ms. Andersen holds her Bachelor of Arts Degree in Marketing Management from the University of St. Thomas in St. Paul, Minnesota.
