Third Annual ESI Trends Report: ESI Management is Top of Mind, But Effective Implementation is Falling Short

According to the Kroll Ontrack Third Annual ESI Trends Report, a chasm exists between the concepts of document retention and ESI discovery readiness – suggesting that many corporations falsely believe that a document retention plan alone will provide protection when litigation or investigations strike. This is one of the key findings from an independent study, commissioned by Kroll Ontrack, which surveyed corporate counsel and IT departments at U.S. and U.K. corporations.
Corporations that fail to institute repeatable and scalable litigation response strategies and are later sued will discover the defensibility of their policy is at issue. The ESI Trends Report stresses the importance of legal and IT departments working cohesively to implement best practices and strategies to effectively manage ESI risks while at the same time mitigating costs.
