Kroll Ontrack celebrates the two year anniversary of Intelligent Review Technology

Technology assisted review in Ontrack Inview used on more than 100 cases and counting, saving clients an estimated $300,000 per case

MINNEAPOLIS, June 11, 2012– June 2012 marks the second anniversary of patent pending Intelligent Review Technology (IRT), which includes automated workflow, prioritization and categorization technologies, within the award-winning review tool Ontrack® Inview™. To commemorate this event, Kroll Ontrack, the leading provider of e-discovery, information management, and data recovery products and services, looked at how the innovation of automated review technology has forever changed e-discovery – driving down the total cost of litigation with document review efficiencies.

“Document review looks nothing like it did 15 years ago when lawyers combed through dusty warehouse paper documents to locate responsive documents,” said Dan Marrone, director of document review services, Kroll Ontrack. “Document review platforms have evolved to include concept searching, topic grouping, near de-duplication, early data assessment, analytics and more. Now, ‘smart’ technology is here, taking document review to the next level.”

With traditional, linear document review, some responsive documents are found each day of the review. Key, responsive documents can still be found in the final 10 percent of the document set. Automated prioritization technology within Ontrack Inview feeds case teams the most important documents up front, empowering them to make strategic case decisions early on in the process. In addition, intelligent categorization technology in Ontrack Inview suggests potential categories for each document, increasing the speed, accuracy and consistency of coding decisions throughout the review. As a result, the time required to administer a review and manually review documents has been greatly reduced. “The backbone of computer assisted review is powerful software that learns to imitate human actions. For e-discovery, this means using classifiers to imitate the human coding of documents as responsive, non-responsive or privileged,” said Dave Lewis, information retrieval expert and president, David D. Lewis Consulting. “These information retrieval algorithms are widely used in other industries outside of legal technology platforms, such as in spam filtering, computational advertising and data mining."

Document review is routinely the most expensive aspect of the discovery process. However, IRT is addressing this head on. In fact, since launching IRT two years ago, Kroll Ontrack has had more than 100 cases leverage the technology, which has been continually improved and enhanced in a series of four updates. Based on a random sampling of 20 cases, with 19,198,751 total documents or approximately 1 million documents per project, an estimated $319,979¹ were saved per case. In one of the 20 cases sampled, a client was able to end their document review six weeks early and save $ $295,130 based on the prioritization technology within Ontrack Inview.

In addition to technology enhancements and client adoption over the last two years, the case law surrounding technology assisted review has also recently expanded. With the landmark judicial opinions in Da Silva Moore v. Publicis Groupe from the Southern District of New York and the consideration of technology assisted review in Kleen Products v. Packaging Corporation of America in the Northern District of Illinois and Global Aerospace v. Landow Aviation in Virginia State court, it is clear that the judiciary is embracing this tool as a mechanism to drive down the total cost of litigation.

“Adoption of intelligent review technology for document review is rapidly gaining momentum. I expect that within the next year or two it will become standard practice for most reviews,” said Marrone. “Lawyers won’t be debating its effectiveness. Future reviews will be performed by focused teams of legally skilled, technically savvy and statistically inclined attorneys capable of conducting document review in a matter of days instead of weeks. Document volumes will no longer be the primary deciding factor in the length of a document review project.”
